Carney Williams, PLLC is investigating whether Clarus Marketing Group, LLC (“Clarus”), which operates a website, FreeShipping.com, and Provide-Commerce, Inc. are perpetrating a fraud upon unsuspecting consumers by offering “free shipping” on internet purchases, but actually enrolling consumers in and charging them for a monthly membership in a shipping program.
Specifically, Carney Williams is investigating whether Clarus and Provide-Commerce are unlawfully using consumers’ credit card information in violation of federal law to enroll consumers in a “free” shipping program then billing them between $9.00 to $15.00 per month.
Provide-Commerce operates several on-line websites, including: Red Envelope, ProFlowers, Cherry-Moon Farms, Secret Spoon, and Shari's Berries. Allegedly as consumers enter their billing information finalizing their purchases on one of Provide-Commerce’s websites, an advertisement pop-up directs the consumer to another website, FreeShipping.com, where the consumer is offered “free shipping” on this purchase and 12 future purchases. By simply clicking on the advertisement, without accepting the offer or entering any billing information consumers are enrolled in this “free shipping” program operated by Clarus. The consumer never provides credit card information in response to the FreeShipping.com advertisement, instead it is alleged that Provide-Commerce provides Clarus with the client’s billing information obtained from the consumers purchase on one of Provide-Commerce’s websites.
If you have purchased items on-line and were offered “free shipping” at FreeShipping.com, you should immediately check your credit card statement for any unauthorized charges. If you have unauthorized charges from Clarus Marketing Group, Inc., CMG, FreeShipping.com or other unauthorized charges you may have been a victim of this consumer scam.
